Environmental Health Placarding Ordinance Richmond Code Section 14-26



Title: Richmond Code Section 14-26. Placarding of structures, buildings or facilities that constitute imminent, substantial or compelling threat to public health or environment; unlawful to occupy or use one placarded.

Element #1: When can Public Health Placard a Structure

"In the event the director of public health or his designee determines that a nuisance as defined in this article constitutes an imminent, substantial or compelling threat to the public health or the environment,"

Nuisances to which this ordinance applies:
-Sec. 14-23. Permitting existence on property by property owner. It shall be unlawful for any person to have or permit any noxious, unwholesome or offensive matter or nuisance of any kind, in any house, cellar or upon any other private property owned or occupied by such person.
-Sec. 14-24, Stagnant water.

Element #2: Who can Placard a Structure

"The director of public health or his designee"

Element #3: What Public Health Can Placard

"May placard the structure, building or facility as unfit or unsafe for human occupancy or use."

Element #4: Where Placards are Posted

"The placard shall be posted at all normal means of egress to the structure, building or facility."

Element #5: Notice to Owners and Occupants"

As soon as possible after placarding, the director of public health or his designee shall mail or deliver a notice to the owner(s) and occupants(s) of the structure, building or facility informing such persons of the reason for placarding and the penalty for occupancy or re-use while placarded."

Element #6: Crimes: Ignoring Placards and Removing Placards


"Once the structure, building or facility is placarded, occupancy or use shall be prohibited. Occupancy or use, or permitting the occupancy or use, of a placarded structure, building or facility shall constitute a Class 1 misdemeanor…Removal of a placard without permission of the director of public health or his designee shall constitute a Class 1 misdemeanor."

Element #7: How Placards Get Removed

"No re-occupancy or re-use shall occur until the director of public health or his designee approves in writing the re-occupancy or re-use."
